China Proposes Export Controls on 23 AI Technologies, Open-Source Exempt
On October 16, China's Ministry of Commerce and Ministry of Science and Technology issued Announcement No. 48 of 2026, soliciting public comment (deadline November 15) on revisions to the Catalogue of Technologies Prohibited or Restricted from Export. The revisions propose adding 40 technologies: 23 in AI, 5 in biopharmaceuticals, and 12 in photovoltaics (polysilicon, wafers, cells, and the equipment embodying core processes). This is the first time China has proposed systematic export controls targeting an AI technology stack.
Confirmed
- The AI controls cover large models, AI agents, compute clusters, and information processing technologies, and also touch on chip design methodologies (per @emmanuelvivier)
- Covered scenarios include IP transfer, outbound technology licensing, and changes of ownership or actual control to foreign entities (@pstAsiatech)
- Pre-export registration requirements took effect immediately on October 16, ahead of the catalog revision itself, which is still in draft
- @emmanuelvivier says models above 2 trillion parameters would be barred from leaving the country, and frames Beijing's move as a continuation and accumulation of its control path since the 2020 Export Control Law
Not yet confirmed
- The catalog is still in the public-comment stage; final entries and enforcement details remain undecided
- The exact boundaries of the open-source exemption: how the Ministry of Commerce will draw the line between "publicly available technologies" and tacit know-how remains to be clarified (@pstAsiatech)
Why it matters
- Key exemption clause: technologies already made public through open source or published papers are unrestricted, meaning already-released model weights such as DeepSeek's are unaffected, though future model release strategies could face constraints
- Multiple authors (@pstAsiatech, @burnytech) note this marks a shift by Beijing from controlling physical inputs to controlling the cross-border transfer of AI capabilities and know-how—a landmark escalation in great-power technology competition
