China's AI tech export controls take effect: models, agents, compute clusters need pre-registration
pstAsiatech · x · 2026-10-20
China's draft revision of its technology export catalogue (comments due Nov 15) is pending, but pre-export registration took effect Oct 16. Key points:
- Scope: IP transfers, outbound licensing, and changes of ownership or control to foreign entities — including deals already underway.
- AI is the focus: large models, agents, compute clusters, and information processing are covered, signaling a shift from controlling physical inputs to controlling AI capability and know-how transfer.
- Open-source carve-out: technology already public via open source or published papers is excluded.
- Official framing: MOFCOM calls it routine catalogue maintenance, not aimed at any country, unlike US controls such as the Entity List.
The key question is where Beijing draws the line between "open" and proprietary know-how — with direct consequences for Chinese AI companies' overseas expansion and deal structures.
