China proposes export controls on 23 AI technologies; already open-sourced tech is exempt

On Oct 16, China's Ministry of Commerce and Ministry of Science and Technology released a draft revision to the Catalogue of Prohibited and Restricted Technologies from Export, adding 40 technologies across AI, biomedicine, and solar PV — 23 of them AI-related, covering foundation/large models, agents, computing clusters, and information processing. Public comments close Nov 15; temporary pre-export registration takes effect immediately.
Key points for open-weight models:
- Technologies already public via open-source releases or academic publications are explicitly exempt
- Open-sourcing AI tech and Chinese firms building overseas compute centers qualify for streamlined automatic licensing
- Providing access via APIs, apps, websites, or SaaS is generally not treated as a technology export
- Overseas local deployment of restricted technologies can fall under the rules
Not a blanket ban on open-weight models, but unreleased new models may face registration or approval before weights or source code go abroad — thresholds based on performance, parameters, and data sensitivity are still being defined. DeepSeek and Qwen could see extra compliance requirements on future releases.
