Anthropic's S1 admits insurance may fall short as legal scholar flags third-party liability gap

Anthropic's S1 filing candidly warns that its models may act in "unintended, misaligned, or autonomous ways," potentially exposing the company to liability, litigation, and regulatory action under still-unsettled legal theories — and admits its insurance may not provide sufficient coverage.
Legal scholar Gabriel Weil pushes back: nothing in the filing is literally false, but Anthropic is downplaying its liability exposure. Terms-of-service limitations "may not apply to certain claims," and the ToS very clearly cannot bind third parties harmed by Anthropic's AI systems, since they aren't parties to the contract.
