OpenAI systematically dismantled Apple's core claims:
- Misdirected Legal Emails: Apple claimed OpenAI ignored their outreach. However, OpenAI revealed that Apple's outside counsel confused two Asian surnames, sending the email to the wrong person while falsely claiming to have spoken with OpenAI's General Counsel on the phone.
- Systemic Access Flaw: Apple accused former employee Chang Liu of accessing secrets post-departure. OpenAI published iMessage logs showing Apple employees actively asked Liu for help finding files after he left. OpenAI attributed this to Apple's poor offboarding system management.
- No Secrets Used: Regarding Tang Tan, OpenAI emphasized he explicitly instructed teams never to use proprietary information from former employers.
