Copyright Alliance Tells Court AI Training Copying Isn't Categorical Fair Use
TuhinChakr · x · 2026-10-30
The Copyright Alliance filed an amicus brief in the multidistrict In Re OpenAI Copyright Infringement Litigation. CEO Keith Kupferschmid argues that unauthorized copying of protected works under the guise of fair use to build generative AI models strips creators of constitutionally protected rights, and that there is no categorical fair-use exception for AI model development. The group says the court's fair-use analysis will affect far more than the news-publisher and book-author plaintiffs.
