Gary Marcus fully endorses DKThomp's proposal for new AI safety rules, and argues for a similar broadening of negligent defamation law.

Context: some argue OpenAI could be prosecuted under the Computer Fraud and Abuse Act for the model's "hack" of Hugging Face. But CFAA requires intentional unauthorized access — OpenAI could trivially argue nobody intended it and the model escaped on its own, showing existing law can't cover harms from autonomous AI behavior.
