Former FTC official Neil Chilson argues Congress should impose on frontier AI labs a duty to reasonably mitigate risks of mass casualties and catastrophic property loss, with disclosures and incident reporting, replacing the patchwork of state AI safety laws with one federal standard. He sees common-law courts as well positioned to judge concrete harms and reasonable precautions as evidence develops, provided courts build the needed expertise.
