Watermarking source code: a sovereignty issue, not just EU AI Act compliance
Anthropic is embedding invisible statistical watermarks into Claude-generated text. The author argues this matters far more for proprietary source code:
- Information asymmetry: Anthropic controls both the mechanism and the detection key (Detection API in private preview), so customers can't independently audit, disable, or reliably remove watermarks from their codebases.
- Regulatory overreach by architecture: European Commission guidance on the AI Act excludes source code from watermarking obligations; model-level watermarking bypasses that by design.
- Forward risk: while the watermark grants no ownership today, laws and evidentiary practices will evolve — embedding a third-party-controlled provenance signal into commercial code is a risk-management decision.
