Benedict Evans says AI regulation should start with an independent investigation, not self-review

Benedict Evans argues that concerns about regulatory capture by the two biggest AI players are real, but that current discussions rely on alarming press releases rather than due process.

He says that if OpenAI truly violated Hugging Face in a way that warrants new regulation, the right first step is a formal criminal investigation with an independent third party and real liability—not letting the defendant effectively investigate itself.

He also questions why new regulation should be written for conduct that is not even being prosecuted as a crime.
