Meta Sued Over AI Algorithm Firing Employees on Leave

26 former Meta employees have filed a federal lawsuit alleging the company used an internal AI tool to generate scores for layoff decisions, resulting in the discriminatory termination of employees on legally protected leave.

According to the lawsuit, the May layoff list wasn't compiled directly by managers but was based on scores from an internal AI tool. This incorporated data such as employee-trained "second brain" agents, keystroke monitoring, and AI token usage dashboards. Because employees on leave physically couldn't generate these active metrics, their scores dropped significantly, leading the algorithm to "wrongfully terminate" them. One scientist was even placed on the layoff list the day before her due date.

Commenters noted this is a classic AI "foot-gun" (self-inflicted wound). Consulting experts during the design phase could have easily prevented this systemic discrimination caused by a failure to account for edge cases.
