China drafts export controls on AI tech: malicious-code AI banned from export, existing open-weight models exempt

China's Ministry of Commerce and Ministry of Science and Technology published draft revisions to the Catalog of Technologies Prohibited or Restricted from Export, covering 40 key technologies across AI, biopharma and photovoltaics — 14 proposed for export prohibition and 26 for restriction.
Key AI points:
- 23 AI technologies would be added, spanning large models, agents, compute clusters and information processing. AI-driven malicious code generation/mutation tech is proposed for outright export ban; AI-assisted vulnerability discovery would be restricted.
- Technologies already in the public domain via open-sourcing or academic publication are exempt; open-sourcing, overseas self-built compute centers, overseas chip fabrication and joint R&D qualify for automatic-license facilitation ("file and go").
- Serving closed models to foreign customers via APIs is generally exempt, but local deployment of restricted models overseas may require a license.
- kuhhbin argues this could let Beijing restrict future open-weight releases from Chinese frontier developers, effectively closing the open frontier; officials frame the rules as targeted, dynamic and not aimed at any specific country.
