Per Axios, the FTC has sent civil subpoenas of more than 50 pages each to OpenAI and Anthropic, demanding documents on AI safety incidents, internal safeguards, marketing materials, and privacy policies. The investigation targets potential consumer protection violations; the agency also plans to compel top AI executives to testify and send additional demands to third-party AI organizations.
On the same day, eight US states—Iowa, Kansas, Nebraska, West Virginia, Arkansas, Arizona, Idaho, and Montana—separately sued OpenAI, alleging it misled consumers about ChatGPT's safety, particularly regarding children. The coordinated regulatory and state-level legal pressure marks a clear escalation in US enforcement over consumer AI safety.
