A recent legal analysis article explored the legal boundaries of AI model "distillation," accusing Chinese AI labs like DeepSeek, Moonshot, and MiniMax of "industrial-scale" illicit distillation of other labs' models.

While praising the article as a good primer, an expert expressed skepticism about whether the arguments against contract law would fully hold up in court. They emphasized that "distillation" comes in many varieties—such as purchasing user transcripts from another lab's model, training on AI-written code from GitHub, or using models to generate LLM judge rubrics for RL—and there is little clear legal boundary between them currently.
