xAI Sues Minnesota Over First-in-Nation Ban on AI 'Nudification' Tech

xAI, Elon Musk’s company, sued Minnesota in federal court on Monday over the state's first-in-the-nation law banning AI "nudification" technology, which is set to take effect on Saturday. The law aims to outlaw the use of AI to create fake nude images of real people.
In a 38-page lawsuit, xAI clarified that it does not contest the state's interest in banning the distribution of non-consensual AI-generated nude images. However, the company argued that Minnesota’s law "extends far beyond that goal," covering many constitutionally protected images and videos, and subjecting companies to a $500,000 penalty per violation. xAI emphasized that the law lacks a "safe harbor" provision for companies making good-faith efforts to prevent such images and even covers images created with consent. The case will serve as a crucial test for how far states can go in constitutionally regulating AI.
