New Trahan-Obernolte bill would let Commerce restrict frontier AI models

The new Trahan/Obernolte bill would create an Under Secretary of Commerce for AI Security, federalize parts of SB 53/RAISE transparency rules, and set up a licensing regime for Independent Verification Organizations that must vet frontier developers and report imminent catastrophic risks.

It would also let the Commerce Secretary suspend or restrict a frontier developer’s development, deployment, or internal use of a frontier model after a written finding of imminent catastrophic risk, while preempting state laws on frontier-AI catastrophic-risk transparency, third-party auditing, independent verification, and incident reporting.
