Joe Kwon and Stephen Casper’s paper argues that frontier-AI regulation still misses a major blind spot: internally deployed systems. The paper says internal deployment can reduce safeguards and expand capabilities, creating three oversight gaps: scope ambiguity, point-in-time compliance checks that miss ongoing changes, and information asymmetries that leave regulators unaware of what companies are actually doing.
It compares AI oversight with other high-risk domains such as nuclear and pharma, where inspectors or detailed reporting create visibility earlier in the lifecycle. The authors conclude that policy should account for internal use before external release, rather than waiting until systems are shipped to users.
