Cryptography expert Matthew Green discusses the legal dilemma surrounding Apple's iCloud Photos when Advanced Data Protection (ADP) is enabled.

He points out that with E2E encryption, no one but the user can see the photos. If a user doesn't share content, Apple cannot possibly act as a "publisher." A judge recently tried to fit iCloud into a specific legal framework by highlighting its sharing functionality, even though there was no evidence the sharing feature was actually used in this case.
